1. Scope of Application
These Terms and Conditions ("T&Cs") govern all legal relationships between Spino’s Authentic Shirt Shop (hereinafter referred to as "we", "us", or "Seller") and natural or legal persons (hereinafter referred to as "Customer" or "Buyer") who purchase goods, sell goods, or use services through our online shop.
Any terms and conditions of the Customer that differ from these T&Cs shall not apply unless expressly accepted by us in writing.
2. Offers and Conclusion of Contract
2.1 Product Presentation
All products, prices, and information displayed in the online shop do not constitute a legally binding offer but rather an invitation to place an order.
2.2 Order Placement
By submitting an order, the Customer makes a binding offer to enter into a purchase agreement.
2.3 Acceptance of Contract
The contract is concluded only upon:
- Written or electronic order confirmation; or
- Shipment of the ordered goods.
We reserve the right to reject orders without providing reasons (e.g., suspicion of fraud, technical errors, supply shortages).
3. Prices and Payment Terms
3.1 Prices
All prices are stated in CHF unless otherwise specified and are:
- Inclusive of applicable Swiss VAT
- Exclusive of shipping costs
For international orders, additional taxes, customs duties, or fees may apply and are the sole responsibility of the Buyer.
3.2 Price Changes
We reserve the right to change prices at any time. The prices valid at the time of ordering shall apply.
3.3 Payment Methods
We accept, among others, the following payment methods:
- Credit Card
- PayPal
- Stripe
- Klarna
- Bank Transfer / Prepayment
- Any additional payment methods displayed in the online shop
Payment must be received in full before shipment unless otherwise agreed.
4. Delivery and Shipping
4.1 Shipping Area
We ship worldwide unless specific destinations are excluded during checkout.
4.2 Delivery Times
Delivery times depend on:
- Product availability
- Destination country
- Shipping carrier
All delivery times are estimates unless explicitly guaranteed in writing.
4.3 Shipping Costs
Shipping costs are displayed during the checkout process.
4.4 Failure to Accept Delivery
If the Customer refuses or fails to accept delivery, storage fees and additional costs may be charged to the Customer.
5. Retention of Title
The goods remain our property until full payment has been received.
6. Right of Withdrawal and Returns
6.1 Right of Withdrawal for EU and International Consumers
Customers residing in the European Union are entitled to a statutory 14-day withdrawal period unless an exception applies.
6.2 Swiss Customers
Swiss law does not provide a mandatory right of withdrawal.
However, we voluntarily grant a return policy according to the conditions published on our website.
6.3 Exclusions from the Right of Withdrawal
The following items are excluded from returns:
- Opened or worn clothing
- Individually sourced jerseys
- Jerseys submitted through our purchasing service and evaluated or inspected by us
- Hygiene products
- Products showing visible signs of use
6.4 Condition of Returned Goods
Returned items must be in their original condition, unworn, unwashed, and with all original tags attached.
Unless otherwise stated, return shipping costs are the responsibility of the Customer.
7. Purchase of Jerseys (Selling to Us)
We also purchase football jerseys from customers. The following conditions apply:
7.1 Authenticity Verification
Every jersey is subject to authenticity verification.
In the event of counterfeit items or attempted fraud, we reserve the right to take legal action.
7.2 Validity of Purchase Offers
Any purchase offer made by us is non-binding and may be adjusted or withdrawn after inspection.
7.3 Payment
Payments are made only after successful inspection and verification and will be transferred to the bank account specified by the Customer.
8. Product Condition and Warranty
8.1 New and Used Products
We sell both new and used products.
Used items will be clearly identified in the online shop.
8.2 Warranty
Statutory warranty rights are governed by Swiss law (Articles 197 et seq. of the Swiss Code of Obligations).
For used products, warranty periods may be limited to the extent permitted by law.
8.3 Warranty Exclusions
No warranty applies in cases of:
- Normal wear and tear
- Improper use or damage caused by the Customer
- Missing original packaging
- Modifications made to the product after purchase
9. Limitation of Liability
We are liable only for damages caused by gross negligence or intentional misconduct.
Liability for slight negligence, indirect damages, consequential damages, or loss of profit is excluded to the maximum extent permitted by law.
Unless otherwise agreed, responsibility for transportation transfers to the Customer once the shipment has been handed over to the carrier (Incoterm: EXW Switzerland).
10. Customer Account
Customers may create an account on a voluntary basis.
Customers are responsible for:
- Keeping login credentials confidential
- Providing accurate information
- Updating account information when changes occur
We reserve the right to suspend or delete accounts in cases of misuse.
11. Data Protection
Personal data is processed in accordance with our separate Privacy Policy.
12. Intellectual Property Rights
All content available on our online shop, including but not limited to:
- Images
- Texts
- Logos
- Product descriptions
- Layouts
- Designs
is protected by copyright and/or intellectual property rights and may not be used without our prior written consent.
13. Force Majeure
We shall not be liable for events beyond our reasonable control, including but not limited to:
- Natural disasters
- Pandemics
- War or political unrest
- Strikes
- Supply chain disruptions
- IT system failures
14. Amendments to These Terms
We reserve the right to amend these Terms and Conditions at any time.
The version published on our website at the time of use shall apply.
15. Governing Law and Jurisdiction
These Terms and Conditions shall be governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
To the extent permitted by law, the exclusive place of jurisdiction shall be Baar, Canton of Zug, Switzerland.
